1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Mallorca Select Real Estate SL ("Company," “we," “us," or “our”), concerning your access to and use of the https://www.mallorca-select.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time. We will alert you about any material changes by updating the “Last updated” date of these Terms of Use. Please ensure that you check the applicable Terms every time you use our Site so that you understand which Terms apply.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by Spanish Intellectual Property laws (Ley de Propiedad Intelectual), international copyright laws, and EU trademark regulations.

Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

3. REAL ESTATE LISTINGS AND ACCURACY

The information provided on this Site regarding property listings, including but not limited to prices, square footage, features, and availability, is for informational purposes only and does not constitute a formal offer or contract.

  • Accuracy: While we strive for accuracy, descriptions may be based on information provided by third parties (owners/developers). Mallorca Select Real Estate SL does not guarantee the total accuracy or completeness of property data.

  • Prices: Listed prices are subject to change without notice and do not include taxes, notary fees, or registration fees associated with property transfers in Spain (e.g., ITP, VAT/IVA, AJD).

  • D.I.A. (Documento Informativo Abreviado): In accordance with consumer protection regulations, the abbreviated information document for each property is available to the consumer at our physical office address.

4. USER REPRESENTATIONS

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity to comply with these Terms; (4) you are not a minor (or have received parental permission); and (5) your use of the Site will not violate any applicable Spanish or EU law or regulation.

5. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user, you agree not to:

  • Systematically retrieve data (scraping) to create a database or directory without written permission.

  • Circumvent, disable, or interfere with security-related features.

  • Engage in unauthorized framing of or linking to the Site.

  • Use the Site in a manner inconsistent with any applicable laws or regulations.

6. PRIVACY AND DATA PROTECTION

We care about data privacy and security. Please review our Privacy Policy and Cookie Policy in accordance with the General Data Protection Regulation (GDPR) and the Spanish LOPDGDD. By using the Site, you agree to the processing of your data as outlined in our Privacy Policy.

7. TERM AND TERMINATION

These Terms of Use shall remain in full force and effect while you use the Site. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site to any person for any reason, including for breach of any representation or warranty.

8. GOVERNING LAW

These conditions are governed by and interpreted following the laws of Spain. Mallorca Select Real Estate SL and yourself both agree to submit to the non-exclusive jurisdiction of the courts of Palma de Mallorca, Spain. If you are a consumer residing in the European Union, you also benefit from the mandatory consumer protection laws of your country of residence.

9. DISPUTE RESOLUTION

Informal Negotiations

To expedite resolution, the Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration

Any dispute arising from this contract shall be determined by one arbitrator in accordance with the rules of the European Court of Arbitration. The seat of arbitration shall be Palma de Mallorca, Spain. The language of the proceedings shall be Spanish or English (as agreed by the parties), unless mandatory consumer law requires the proceedings to be in the consumer’s native language.

10. CORRECTIONS

There may be information on the Site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update the information on the Site at any time, without prior notice.

11. DISCLAIMER AND LIMITATIONS OF LIABILITY

THE SITE IS PROVIDED ON AN AS-IS BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

LIMITATION OF LIABILITY: IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE.

Note: Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, gross negligence, or any other liability that cannot be excluded or limited under Spanish Consumer Law.

12. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, or claim made by any third party due to or arising out of your Contributions, use of the Site, or breach of these Terms of Use.
